Dissent

The case was in the end decided 8-1 by the justices. The sole dissent came from Justice Potter Stewart. He believed “ The doctrine relied on in that case as implausible, given the long history of government religious practice in the United States, including the fact that the Supreme Court opens its own sessions with the declaration, "God Save this Honorable Court" and that Congress opens its sessions with prayers, among many other examples. After the case he went on to state “It is, I think, a fallacious oversimplification to regard the [religion clauses] as establishing a single constitutional standard of "separation of church and state", which can be applied in every case to delineate the required boundaries between government and religion.... As a matter of history, the First Amendment was adopted solely as a limitation upon the newly created National Government. And it is said many of the critics to the Court findings quote the justice when he said “If religious exercises are held to be an impermissible activity in schools, religion is placed in an artificial and state-created disadvantage.... Your Own Argument

I most definitely agree with the end decision. I do think religion being separate from state ensures the freedoms of society. I do not want to speak bad about religion or its practice. But the only thing I have a SERIOUS problem with is religious Christians or Catholic beliefs that state they leave no room for belief in another god, that there god is a jealous god. And they do not recognize any who do not believe in there god and look down on all other faiths and non faiths. Or that if I do not believe in their god I will go to hell. OOH that’s a great scare tactic. That’s how entire governments keep their citizens at bay, through fear. So that mentality I have a problem with. But going to church having coffee with like friends or listening to an inspirational sermon, I have no problem there. Not even with saying a good night prayer or reciting Hail Mary’s, whatever helps you get through the day. Keyword: YOU… not me. I get my own choices in life and I love my country for that! My Case Argument would have to be how local governments supersede national law. Or how can they pass a law that is not first approved by a national standard in the first place? Why can any local government make it’s laws and then the wait for the test of time to finally allow for justice? I’m sure there are reasons the courts don’t work in reverse but in this case I think the Supreme Court judges could see the real problem for what it was because it wasn’t their City, State, or Town. So then again, what if it was? Would they still see it from the outside looking in?

Rule of Law

As I previously stated the rule of law that existed before the case was before the Supreme Court consisted of two laws, The Free Exercise Clause, and the first Amendment’s Establishment Clause. These two laws allowed for the courts in America to dance around the subject to try and leave little to no wiggle room for a big change with regards to religion and school. The School District’s argument was valid with law binding points that in some way allowed for the practice to go on legally for as long as it did. The School District stated the Establishment Clause was specifically in place to prevent congress from making any laws regarding the establishment of Religion. This was intended to not suppress the right of those who already did believe and wanted to continue to practice religion. Not to misconstrue the idea and allow public school to impose religion on our youth and then not allow congress to “make any laws preventing the it’s practice.” The second was the Free Exercise Clause, which was intended to keep law makers from preventing the practice of religion or dictate the way its practices should be conducted. Again this was to protect those who believe in religion, not to force those who did not believe to practice against their will. Our youth is the most vital thing to our society and although I believe the majority of religions have a “do good get good mentality” yet it is not their right to make me think and feel that way about their book and their god unless I first choose to. This is a tough call for those in power many decades ago. They risk the uprising of “Hippies” or the enslavement of free expression and idea. Big choice for any human let alone a judge who has to decide the fate of millions of Americans alike. How do you not let your own bias get in the way of your decision? Can judges put their own personal beliefs aside for the sake of a society and a 200 year old piece of paper they swore in oath to uphold and protect? The best judges I think somehow do.

Reasoning of the Court

The courts did not have much reasoning for the case I feel because there were too worried about making judgments that contradicted previous laws and not judging the relevance of the case as the constitution would see it. There seemed to be a lot of influence through the commonwealth of the nation to uphold these laws and all judgments handed down up until this point. It seems like if the Supreme Court could avoid hearing the case the commonwealth could avoid the impending doom handed down by the judgment. The Establishment Clause and the Free Exercise Clause were the two laws that allowed for contradiction to the rightful decision. The District Courts had a hard time finding for Schempp because they contended the laws already in place contradicted any other decision. My personal opinion is there would have been a large local political influence because many people in Congress at this time and even today are religious Christians. It took many decades to be able to ensure justice and uphold the integrity of the constitution and our nation but in the end it was done.
On June 17, 1963 The Supreme Court made its decision. It found (“The reading of the verses, even without comment, possesses a devotional and religious character and constitutes in effect a religious observance. The devotional and religious nature of the morning exercises is made all the more apparent by the fact that the Bible reading is followed immediately by a recital in unison by the pupils of the Lord’s Prayer. The fact that some pupils, or theoretically all pupils, might be excused from attendance at the exercises does not mitigate the obligatory nature of the ceremony for . . . Section 1516 . . . unequivocally requires the exercises to be held every school day in every school in the Commonwealth. The exercises are held in the school buildings and perforce are conducted by and under the authority of the local school authorities and during school sessions. Since the statute requires the reading of the 'Holy Bible,' a Christian document, the practice . . . prefers the Christian religion. The record demonstrates that it was the intention of . . . the Commonwealth . . . to introduce a religious ceremony into the public schools of the Commonwealth. (201 F. Supp., at 819; quoted in 374. Decision of the Court

The case Abington School District v. Schempp was only one of many cases brought before the courts weather at the city, state, or local level. Starting from about the year 1910 similar cases were being brought before the courts regularly. There were two pre-existing laws that took a long precedence before overturning the decision in the Supreme Court Case. The first was the First Amendment's Establishment Clause which stated (“Congress shall make no law respecting an establishment of religion.”)http://legal-dictionary.thefreedictionary.com/Murray+v.+Curlett The other law is the Free Exercise Clause ("or prohibiting the free exercise [of religion]"). http://legal-dictionary.thefreedictionary.com/Murray+v.+Curlett These two laws were the previous precedent for all decisions of the courts alike. From about the turn of the century there were laws in certain areas barring the practices of religion and other areas that tolerated it or even condoned its practice. The laws in place at the time before the case went to the supreme court were based on various decisions directly relating to the two previous laws already in place and not the constitutionality of the practice of religion in public schools by itself. The case Abington School District v. Schempp was brought originally before the district court where Schempp was awarded a victory. The School District appealed to the courts and soon after a clause was written into the judgment allowing for the students to be excused as an alternate means of continuing the practice. Schempp was not satisfied stating implicitly there was still no separation from church and state. His case was then brought before the Supreme Court and then ordered back down to district court for a new trial. Schempp again won a b the case by a clear margin. And then again the School District appealed to the Supreme court, where it would finally be decided by the Supreme Court of the United States.

First Monday in October

After watching a brief part of the movie” First Monday in October”, I was introduced to different points of view regarding the porn industry in America in the 70’s. On one end the woman felt the evidence was relevant and distasteful. And the other justice did not feel he had to watch the movie, he already had his mind made up the movie falls within the first amendment rights protected by the government for all citizens. My take on the situation is that the porn movie is and should remain protected and the form of expression be a right of any and all citizens of legal age. I say this because even though the form of expression is lewd and distasteful and greed driven it is not the right of the government to set standards, because any infringement is a violation of the first amendment right and would only lead to more censorship. However there is a line needed to be drawn and made clear, any threat of safety made by any citizen affects all citizens and therefore should not be tolerated under the first amendment rights. There are many other cultures that take the notion of a naked person as normal and widely accept the idea of an appealing nude figure. In America the elders of the country fear chaos and think by limiting exposure to materials like this it benefits society in the long term, and it may. However it is not their right to make those decisions, only establish an opinion. There is no immediate health or safety issue pertaining to the practice of x rated films, it is a very profitable industry and quite frankly there would always be a black market for porn so the government might as well accept it as our right and just tax the product. The American ideals are funny and misunderstood, our rules and laws come from fear. Fear of an epidemic toward society, so much so we segregate, separate and group likenesses together to form popular opinion in hopes of trumping the opposition. Our laws come from different times and day in age, like when African Americans were slaves or when citizens feared the up rise of their race in America. Women’s rights… need I go on? We are all human and our ideals are all screwed up. I think the United States government goes to great lengths to right its past wrongs but safety and prosperity should be the only ideals guaranteed and protected by any government. Not exploitation and greed. I will leave this post by saying; I walk this earth with two moral laws, do not hurt anyone who doesn’t hurt me first, and do not suppress my freedom of expression as I will not suppress yours. And if you think my freedom of expression hurts you… close your eyes, turn around and get out a dodge! That’s your right! Your rights do not include suppressing my rights. Those are my moral laws, follow this ideal and all humans can co-exist I think.

Illicit Means

To me this is a funny topic because who doesn’t like the idea of something for free or something for nothing or even for less than its value. The moral to the video in the end stated the problem will never be solved until or unless the people trying to stop it take a look at the demand. I totally agree, personally I don’t give a shit about knockoffs or piracy and the problem it causes. If you asked me it’s just two groups of people saying to one another they can and will sell a product for what they think its value truly is because the people they associate with say they can.
On one side you have government, free trade agreements, copywriting, brand identity, registered trademarks and a company with the right to use produce and sell that product for whatever they think its worth, 2-3 or more times it’s initial or resale value. The government protects the company’s right to the product and threatens to stop lookalike or knockoff products.
On the other side you have people who are part of a chain of networks that undermine the authority of protection and in-turn participate in the production of the same products which become for sale to the same demographic only for a cheaper price than the originals.
Here’s my argument: If the same people who created the originals would sell the products based on a profit percentage and not a greed incentive their product knockoff would have a hard time to compete. Yet here you have a government who protects the greed and rights of these companies to allow product inflation to the point a product is bought not for its use but to identify class representation among society.
I feel everyone should have the right to protect an idea or creation, DON’T TELL ANYONE! Short of that if you let the cat out of the bag and someone steals or copies your idea the only thing you can do is… “Be better than they are…be the best.” That is the only recourse you should have, not laws, jail or crime. It would allow the best products to be produced and at the most cost efficient price.
So even though I’m studying Graphic Design and I would hate to have my ideas stolen only to watch someone else make money off them. I say this… “I’m going to use everything I can get my hands on digitally from the internet, analyze it and come up with my own ideas to sell and market. Once I get there I will look only to myself to be the best at what I do because that is where true competition lies, within yourself.” I will not look to a government for protection or a (piece of paper) patent that says it’s my idea just because some paper issuing patent people said so; I don’t want any part of the courts or law. Point blank if I’m there in the first place it’s because someone figured out how to do the same thing only better. And I’m not in the business of being right or first. I’m in the business of being the best and making money.
I watched a movie last night called Flash of Genius, and in it the man claims although Dickens did not invent the English language, or even a single word in the English dictionary, yet the book “A Tale of Two Cities” is his, and the order of the words he used in the book make it his creation and no one else’s. All Dickens did is rearrange the pieces of an already existing puzzle to create his own work of art. Someone could say “…that’s not his; he would have to invent his own language and then write it for it to be his.” How stupid is that? The point I’m making is once something is created, invented, and shown to the world it’s every ones idea, the first person to get to the bank is the smart one, the real genius!
Stealing people’s ideas and profiting off them keeps commerce in check and keeps governments and greedy corporations from running away with supply, demand and all the profits. That concept rules the global market, no government, country, mafia or cartel can control it entirely. Because if they could their profit margin would be no different from the companies they protect, like Louis Vuitton.

Issue of the Case

For the Supreme Court Case I chose Abington School District v. Schempp. The case directly involves the concept of separation of church and state, but more specifically deals with dissolving the practice of religion in the public school. The case became the precedent for all cases alike nationwide.

For next week I plan to talk more about the state level cases, their decisions, and how they affected the length of the status quo in America. The nation was at one time torn on the issue, handing down decisions based mostly on the region of the nation they were first brought about. In other words if the Catholic movement was big in a certain town, area or state then that became common practice, as it was first tolerated then allowed then written into law.
Personally I think the government was founded on a basis that religion was a perversion of society and the United States Government did not want to force upon nor deny the will or god given rights of any citizen within its great nation. After decades of drugs and violence and lawlessness the public opinion changed and there was considerable reason for change even by force if necessary. The catholic movement has by this point spread worldwide and become the most popular of the religions in America at that time. The conservatives elected to office based on their class representation allowed them together to form a type of holy alliance where they would in-turn share their view with the children of their great nation. They did not care they would be breaking the rights of all citizens. They felt it was their responsibility to bring about the best civil orientated society they could. Religious beliefs are just one of those things that do not belong in a democracy under any circumstances even when the greater good is its only goal, because the movement will sooner or later become one in vein. The beliefs people acquire with religion in life they are willing to take with them to death, and when you mix religion and patriotism you will always have a divide in opinion within the nation. The founders knew this would create divided and that is why they did not allow it. Also most if not all the founders were not even religious men at all. "Christianity... The United States of America was the only thing the founders wanted its citizen to die for. They knew this dual relationship would in the end bring about no good. I believe the law makers of their time believed they were doing well merely not seeing the problem it would create. Not all people respect, value or believe in religion, often having a book or god to reference of their own and one that does not allow for more than one belief. Also there are those who believe in no religion, these circumstances account for the problems that were to one day be brought before the Supreme Court.

Facts of the Case

In 1963 Abington Township School District v. Schempp was brought before the Supreme Court. The case began as a result of what was called school sponsored bible reading. Every morning the school would begin the day by reading from the bible to the students or even making them read aloud the scripture themselves to the class. In 1928 the law (24 Pa. Stat. 15-1516) was amended into public law. It stated that at least ten verses from the Holy Bible be required to be read aloud at the opening of each school day. The Schempp family contended the law directly violated the First and Fourth Amendment Rights afforded to them by the constitution.

Laws pertaining to the case prior to it being brought before the courts consist of Twenty-Five states having laws allowing optional Bible readings and the remaining states had no laws pertaining to Bible readings. Of the twenty-five, eleven of the states allowing state sponsored prayer had the courts declare them unconstitutional.

When the case was brought before the district court it ruled in favor of Schempp stating he had the right to excuse his children with written permission from the exercises. Schempp was not satisfied insisting there was still no separation from church and state and the students civil rights were being violated by simply allowing the prayer to take place in school at all.

The case was eventually brought to the Supreme Court where the Court decided in favor of Schempp 8-1, July 17, 1963. The case was to take the lead in several similar State level cases brought before the courts. The ruling that school-sponsored prayer is unconstitutional was condemned by many religious conservatives and praised by those believing in separation of church and state. From this day on all states nation wide were to discontinue all schoo-sponsored prayer and or Bible readings and they were now illegal to condict in all public schools.

Pacific Heights, Red Flags.

In the movie Pacific Heights, the main characters are a couple in San Francisco who purchase a house with rental units and decide to remodel the home and rent the extra units to turn a small profit. The two complete the remodeling and begin to interview possible tenants for the studio and 1 bedroom units. The 1 bedroom is rented first and the process for the most part is done by the book. However the studio apartment is first shown to a man who appears to want to bypass the correct process but in the end complies with the landlord request. The credit application is returned the next day under the door of the Victorian home and lost from there never finding its way to the landlord. Whether it was a mistake or a set up what follows next is for sure to cause many of problems for all parties living within the home. Michael Keaton plays a man who perceives himself to be wealthy based on the porche he drives and the several hundred dollars he flaunts while looking over the studio apt. Red Flag 1. He neglects to fill out the credit application stating his references will speak for themselves and all the landlord need do is call to verify. Red Flag 2. Keaton then offers to pay the first six months up front as he counts several hundred dollars, he says he’s a little short but assures the landlord he will wire the money within the week. Red Flag 3. The following day the man brings in personal belongings into the unit and the female landlord takes minimal to no action. At this point you’d think the situation would have corrected itself before going further. She should have never allowed a single belonging to remain in the home until or unless there was a proper lease written and signed. By not doing so under California law the landlords willingly turned over possession to the new tenants. Red Flag 4. From this point the story only becomes weirder. The final flag I think is when the references don’t pan out and the bank has no knowledge of the supposed wire transaction for the rent. Soon after this point the landlord finds out he has little recourse and the problem will now take anywhere from 6-8 weeks to 6-8 months to evict, depending. Quite the price to pay for not dotting your I’s and crossing your T’s when initating a lease agreement. Win or lose from here on out you have already lost all you stood to gain for several months rent.

Smash Me Doll

The Bernie Madoff ponzi scheme inspired a doll and hammer costing $100.00. No sooner was an order for 1000 units to be mass-produced and the toy gift was an instant hit. Teach said to come up with our own Smash Me doll and I know my ultimate pick for sure…Smash your Baby Mama Doll!

Personally I love my mom and all moms for that matter it takes a special kind of woman to be a mom, any one who’s ever been a kid knows that! With that said, there’s another side to the picture. I love my daughter so much and from the day I was to be a single dad I said I wouldn’t let her down no matter what. My baby’s mother is something else. She has no concept of sharing the dual relationship of raising a child in a tension free broken home. It’s her way or noting and I’m sure she’d say the same for me so whatever… I could totally picture an instant success.

How bout Baby Mamas and Daddies Smash me dolls collector set and individuals!

Greed is Good?

Is greed a good thing? No but after watching the movie Wall Street and hearing Michael Douglas’s character give a speech that greed is a good thing I would have to agree. Greed stands for a lot of emotions like determination, desire, willingness, ambition, ect. These are the principals that have brought the American society to where it is today. Survival of the fittest is key when considering who succeeds and who doesn’t. Greed is more of a battle of wits than muscle or intimidation. The small skinny smart guy is likely to be the shark and the big dumb idiot with extra money is likely to be the bait. Greed weeds out the bad seeds if you ask me, and they’re the ones who were never going to financially flourish anyway. All that leaves is smart people finding ways to take advantage of other people’s financial situation to benefit their own.

Greed is a human instinct and represents a lot more than just money. All physical possessions and emotional satisfaction we strive to gain more of even if it means taking it from others no matter the cost. Greed may have brought a society to the great place it is thought of today but at the expense of how many countries, governments and citizens of the world. All together to me… greed is a horrible thing; the idea that I can willfully outwit someone out of something they equally desire just because I’m smarter is taking advantage of them in what our society considers for the most part legal transaction. The fact is Greed weeds out the idiots and survival of the fittest is a fact of life so accept it along with all the injustice, mistrust and misuse of authority. Because in the end having all the smart people running shit is still better for the whole (society) than sharing authority’s equally. America is a Democracy and by definition is not a greedy type of government. Yet and still the Corporatism political appointees and presidents have allowed has literally sold out the American people, future generations, its recourses, along with its self worth and dignity. "A corporation is a business formed as a separate legal entity"(Essentials of Business Law 6th ed., Liuzzo & Bonnice, pg. 268) American business and government bankrupts other countries and its citizens because?...better them than us right . That’s all greed is, it has two sides and no one wants nonprofit side.

Political officials profit individually and the American society suffers collectively, where is the accountability. "Feduciary responsibility is a lega requirement that a person will exrecise his or her authoritywhile working under duty of loyalty and a duty of care."(Essentials of Business Law 6th ed., Liuzzo & Bonnice, pg. 270)There is no Greed Court. Our gold standard meant something a hundred years ago until it was privatized into the Fed, which we still consider a government entity. When it is not, it is a private bank that pays no taxes has no laws for accountability and answers to no one. So what do you do when your gold volume is private and refutably audited for over 20 years? Accept it… accept that your money is worth what they tell you it’s worth. And if the people running the show hand out too many bonuses or even become victims of greed themselves. They print more money to fix the problem and tell you its still equal to the same amount it was the day before.

To me that‘s the ultimate pansy scheme to sell America to people of other countries and their governments piece by piece until one day it’s no longer America. Either they don’t realize they are traitors or they don’t care but in my opinion all life is ruled by greed, you wouldn’t have your accomplishments today without it. But for every accomplishment that ever came to someone came hand in hand with the failure of someone else. So yea we are all created equal but it is our greed that separates us later on in life. Nothing more nothing less. Greed is the root of all evil, money is just a piece of paper. My sixth grade teacher said, “ It’s only worth a dollar because you think it’s worth a dollar.”

MySpace Quote Comments

After reading some of the other blogs posted by classmates regarding the MySpace Hoax case I had these comments…

I agree with this comment, the adult (Nancy Drew) is in my opinion taking advantage of minor through deviant means. It is wrong and should not be tolerated among society. However the responsibility in my opinion lies with the parents who lost their child. They are responsible for their child at ALL TIMES. Society wants/tries to establish blame and no one wants to blame the parents of the victimized child, ultimately this world is a cruel place and they are all victims of a tragic accident. No faults no blame just things that could have been done differently but in this case weren't.

I love this comment. Because I can relate to those days when problems like these didn’t exist. They were real life in your face PROBLEMS. And now there is a whole new world of communication through Internet. I almost seems artificial because to me because you have to “pay to play”. Not literally but really if you don’t want Internet problems, don’t use the Internet! Try telling that to our kids ten years from now. HA! But real life in your face problems don’t go away, you must overcome the REAL obstacles in life amongst your peers.

This is true she did not publicly give an apology nor show any remorse throughout this matter. However I believe she can relate to the idea of losing her own daughter for something just as meaningless let alone the thought of going to jail and being away from her child having already shown her family what kind of a member to society she is. Nancy Drew is responsible for 99% of the moral ethic that went wrong here and I think she knows it. The other 1% is why a 13 year old had a MySpace page in the first place? I’m not giving Nancy Drew a free ride in my comment but just ask yourself this… “ Do you think Nancy Drew wanted the minor child dead?” I don’t. I think it is very likely she was counseled by a lawyer to not comment specifically so that the Prosecuting attorneys nor the family could produce accountability before the courts did! “Innocent until proven guilty.”

Yes it’s true just like a post card or the telephone we will always use any means of communication that is more efficient than the last, and we should! Having long distance relationships with all kinds of family and friends is a great thing when you’re all computer savvy. The point I’m making is there’s no room in there for strangers, just like in real life weather you’re a kid or not 9 out of 10 we say no to strangers right! Even still we are all going to come in contact with people who don’t care about us who are willing to take advantage of us anyway they know how. The important thing is to see it before it comes or realize before it’s too late. The real lesson is to be aware of your surroundings and to interact with people you trust. Again there’s no room for that kind of security in a place they call CyberSpace.

I like how you suggest that although a lawyer is a respected profession, they are looked at as money hungry people who take advantage of others in need of their help. The real point I think is that even thought we don't like lawyers, we like jail or punishments even less. And if the one person who can see to it we are not punished unfairly or even punished at all happens to be a lawyer then so be it, then we like lawyers. Finally I think the real cost here is freedom and the price people are willing to pay for it is infinite. After all something is only worth what someone will pay for it!

What do I think about the Grand Theft Auto Sex Law Suit? The lawsuit filed against the makers of the video game because the makers allegedly put hidden sex scenes within the storyline. The scenes were revealed to players who downloaded a third party code. The maker of the code stated he was not at fault because the scenes were already implemented within the game and he was only offering access to a preexisting part of the game. The case was brought to court and anyone who purchased the game was able to sign up to be included in the settlement. The court established the plaintiff’s must try the case on an individual state level and not collectively through a New York Federal Court.

The plaintiff’s all suited the makers of the video game and were awarded a little over a million dollars. The money was to be divided up amongst the plaintiff’s with the obvious majority going to the team of lawyers. In the end customers were to be awarded a much as $35 per claim intended for reimbursement. The lawyers however were to collect $955,000.00. This is outrageous to me because although they earned their money they have basically become the sole beneficiaries of the case and not their clients. I feel like I’m left with so many questions concerning the settlement.

To me the lawyers see a loophole within the system and they know they can access damages and win. The Plaintiff’s have what they feel is a legitimate claim and either hopes to be reimbursed or overly compensated which isn’t right either. In the end it just seems the case is pointless and meaningless to the sanctity of the justice system. More perversion came from the outcome than went into the ridiculousness of the claim. Lastly if I had my way with the case I would award the lawyers $45,000 and their clients would receive the 955,000. This way it shows the damages are real and the payday comes fair to all involved. Not all would agree but they’re just the ones who would get less money. After all that’s all this is about someone trying to take someone else’s hard earned money.

What I Think of Lawyers?

I think lawyers are professionals who specialize in protecting the integrity of the laws of government and the society within. Lawyers are expected to go through several years of education while studying in depth a specific area of law or case study. Once a lawyer graduates law school I imagine they either open a private practice or start an entry-level position in attempts to work their way up as an employee.

This is the point where I see many lawyers following the money more than the desire or passion that first brought them to law school. I imagine they see the perversion within the system and realize there is little to no money in truth. Many lawyers exploit its citizens or find ways to bend the law or the moral the law is based on. The corruption is deep and the consequences relenting, our Constitution and our freedoms sometimes at stake.

If lawyers are set in place to respect the integrity of the system, then why is the very best private criminal defense attorneys turned to the other side? Money. Because their too good at what they do and their purpose is then better served for the government. Government? That’s right the District Attorneys advise strict charges initially so that they may accept a plea and therefore remain consistent in convictions. A loss to the DA can be devastating to a lawyer or its city. And America doesn’t like losers. The Justice Department too often is caught up in ego and dollar signs, and not the laws they protect. After all they only want to go home and feed their families at the end of the day and no coach wants to lose on any given Sunday.

MySpace Hoax

What do you think about the MySpace Hoax Case? I think the acts committed by Lori Drew and her daughter, are not criminal. Life is life and people can’t legally be held responsible for causing someone to have a bad day. Lori Drew is not responsible for the state of mind of the 13 year old, nor her weight or her choice in friends. The parents of the 13 year old girl are however responsible for her choice in online browsing, her health, state of mind and peer group. The personal circumstances regarding the case are disturbing and the situation does become deeply immoral but I feel it is not criminal. “Ethics is a philosophical approach, examining theories of what is good or bad. Morals are concerned with behavior as judged by society. Values are beliefs or standards considered worthwhile.”(Essentials of Business Law, Luizzo, page 23)

The immoral factors regarding Lori Drew’s actions include false impersonation, slander, and the fact she is an adult preying on a teenager is most disturbing. In my own experiences in life I have encountered countless amounts of bad days filled with gossip, false statements, lies, and personal attacks on myself by others around me. Nothing any of the people did to me was criminal, yet had I killed myself popular opinion would establish blame accordingly. To me that is what happened here.

Because MySpace was a relatively new phenomenon people were and always going to be susceptible to all types of false circumstances, the first instances will always establish the future of the product. Public opinion wanted to establish strict punishment in this case to prevent further misuse. Does that mean Lori Drew is guilty of a law not yet in place? It shouldn’t. In my opinion when cases like this are brought before the Justice Department, they find any way to peruse the case to benefit public opinion and not necessarily the laws currently in place. The reason I believe they do this is to set a standard or precedence in future cases. Too often the cases brought before the courts today are decided by previous cases and the rulings made in regards to them. If Lori were not found guilty of any wrong doing then future cases most likely end the same way. Therefore the Judicial department was going to establish some form of wrong doing originally charging her with 4 felonies’s to establish a sense of seriousness while fully realizing if they charged her with enough infractions the jury would eventually find her at fault for something. “Individual and group values are influenced by religion, tradition, and customs.” (Essentials of Business Law, Luizzo, page 23)

The case ended with Lori found guilty of 3 counts of computer fraud. My question is this…” If the 13 year old girl had not killed herself did Lori commit a crime? And why aren’t the other 20 million fake MySpace profiles investigated removed and the individuals prosecuted? “As you can plainly see Lori was not convicted of any charge relating to the death of the girl, so why is she guilty of computer fraud and 20 million fake MySpacer’s are not? Well maybe they are, but the truth in the answer is that while what Lori did was wrong from an immoral point of view it was not illegal, but it was about to be! Public opinion is the law not the law, and while that is not an accurate statement there is truth to it. Our system bends and breaks the rules to suit the public not the private. Finally in my opinion the laws set in place by the Constitution were established for the greater good of society and it is the individuals within that society that bastardize and exploit that system for nothing more than money or personal gain.
